Welcome to FaceSwapLab (the “App”). You are reading the terms of service (the “TOS”), which govern the relationship and serve as an agreement between you and us, setting forth the terms and conditions by which you may access and use the App and our related services. For purposes of the TOS, “You” and “your” means you as the user of the App.

By downloading, updating, accessing, and/or using the App, you agree to be bound by this TOS. You understand and agree that we will treat your access or use of the App as acceptance of the TOS and our Privacy Policy. You agree that by downloading the App from recognized distribution platforms, you are bound by the respective terms and conditions of such platforms.

1. Description of Services

1.1 FaceSwapLab is an online face-swapping application that uses artificial intelligence algorithms to create unique content (“Services”). You may use FaceSwapLab immediately after registration.

To begin, upload a photo, image, GIF, or video from your device (“Uploaded Materials”) for face-editing processing. Our AI algorithms will scan the media, find the faces, and swap them into a new object (“Created Content”). Some functions may be limited if you are not a paid subscriber.

1.2 Subscription: Some services are available only for paid subscribers. The subscription begins after the initial payment, which should be performed via the method and amount indicated at the time of purchase. You are responsible for payment of all fees, charges, and taxes related to the transaction.

2. Legal Capacity

You understand and warrant that:

  • You are of legal age to form a binding contract with us.
  • If you are under the legal age, you shall access or use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.
  • You are not prohibited from using the App under any applicable laws.

3. Content

3.1 We reserve all rights in the App and the technology, systems, and software used to provide the App. You retain all intellectual property rights to Uploaded Materials and Created Content.

3.2 You grant us a non-exclusive, royalty-free license to use Uploaded Content to provide the App's functionality. You warrant that your Uploaded Content does not infringe any third-party rights.

4. Restrictions of Conduct and Content

4.1 In accessing and using the App, you agree to abide by the following rules:

Do not modify, adapt, or reformat the App.

Do not attempt to discover the source code.

Do not interfere with the App's security features.

Comply with all applicable laws.

4.2 You shall not upload content that is unlawful, harmful, or otherwise objectionable.

5. Claims of Infringement

5.1 Copyright: If you believe materials on the App infringe your copyright, you may send us a notice requesting removal.

5.2 Other Rights: If you believe materials infringe other rights, you may send us a notice with relevant information.

6. Indemnification

You agree to indemnify us from any loss, costs, liabilities, and expenses resulting from your breach of this TOS or use of the App.

7. Disclaimers; Limitation of Liability

The App is provided on an "as-is" basis. We disclaim any warranties and are not liable for any damages arising from your use of the App.

8. Links to Third-Party Websites and Services

The App may contain links to third-party websites and services. We assume no responsibility for any damage or loss from using such content.

9. Governing Law; Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

10. Changes to this TOS

We reserve the right to update this TOS. Changes will become effective immediately upon posting.

11. Termination; Assignment

This TOS will continue until terminated by either you or us. We may terminate your access for any reason, including breach of this TOS.

12. Miscellaneous

If any provision of this TOS is found to be unenforceable, the remaining provisions will remain in effect. This TOS constitutes the entire agreement between us and you.

14. Refund Policy

14.1 Eligibility: Refunds are available only if no credits have been used since the latest payment and the request is made within 14 days of the transaction.

14.2 Processing: To initiate a refund, submit a request via the Feedback Form. Approved refunds are processed to the original payment method.
